Terms and conditions

Conditions of sale

These conditions govern the purchase of made-to-order 3D letters, symbols and logos at relevo3d.com. By completing an order, you accept what is written here. Read it before you pay, above all point 7.

1

Who is the seller

The seller is [RAZÃO SOCIAL], tax number PT314797793, with its registered office at [MORADA DA SEDE], registered at the Commercial Registry under number [NÚMERO DE MATRÍCULA], with share capital of [CAPITAL SOCIAL].

Contact: talkto@relevo3d.com. We reply on business days.

[MENÇÃO DE ISENÇÃO DE IVA, SE APLICÁVEL]

2

Scope and who may buy

We sell to consumers and businesses in the European Union. To buy you must be at least 18 years old and have the legal capacity to contract.

All pieces are made to measure from the options you choose: text, font, height, colour and interior or exterior finish. There is no stock: each order goes into production after payment.

3

How the contract is formed

The display of products on the site is an invitation to treat, not a binding offer. The order you submit is your offer to buy.

Before paying you see a summary with the exact text to be manufactured, the font, the height, the colour, the finish, the number of characters and the total. The contract is only concluded when we confirm the order by email, after payment is confirmed.

We may decline an order, with a full refund, if the content breaches point 9, if there is a manifest pricing error, if the uploaded file is unusable or if we cannot deliver to the indicated destination.

In fonts that have only uppercase, the text comes out in uppercase. This is flagged in the configurator and the summary shows both lines: what you typed and what will be manufactured. What counts is what is in the summary.

4

Prices, VAT and currency

Prices are shown with tax included. VAT is that of the order's country of destination, which means the same product may have a different value depending on the country of delivery.

The price depends on the number of characters and the chosen height. Spaces are not charged. Volume discounts apply from the number of characters indicated in the configurator.

The currency is determined by the delivery market and confirmed at payment by the country of the payment method and the billing address. The currency is not chosen by the customer.

The final price is always recalculated on the server before payment. If there is any discrepancy with the value shown in the browser, the value calculated on the server and shown in the final summary prevails.

Shipping and delivery times are indicated before payment. Card details are collected by Stripe and do not pass through us.

5

Production, lead times and shipping

Production begins after payment is confirmed. The lead time shown on the site is the production time, to which transport time is added.

Lead times are good-faith estimates based on the production queue. If we learn that a lead time will be exceeded, we let you know and you can choose to wait or to cancel, with a refund, provided the piece has not yet gone into manufacturing.

We ship across the whole European Union, with no customs costs. Delivery is made to the address you provide: check it, because a wrong address means a new shipment at your expense.

The risk of loss or damage passes to you at the moment when you, or someone designated by you who is not the carrier, takes physical possession of the goods. If you engage a carrier of your own choosing, the risk passes on delivery to that carrier.

6

Preview and final product

The preview is a scaled representation and serves for you to decide proportion and composition. Colours on screen vary with the monitor, so there may be a slight difference compared with the physical piece.

The chosen height refers to the text as a whole and not to each individual letter. Letters with ascenders, descenders or accents occupy different heights within the same set. Small dimensional variations inherent to additive manufacturing are tolerated.

7

No right of withdrawal on personalised pieces

The pieces we sell are made to your specifications and clearly personalised. For that reason there is no 14-day right of withdrawal, also known as the right to cancel.

The exception is set out in art. 17(1)(c) of Decree-Law no. 24/2014 of 14 February, which transposes art. 16(c) of Directive 2011/83/EU.

Before paying you must expressly tick that you have understood this condition. Without that confirmation the order does not proceed. This does not affect your rights in the event of a defect, which are set out in point 8.

As long as the piece has not gone into production, you can ask to cancel by email. We do our best to accept, but once printing has begun there is no reversal: the material has already been consumed.

8

Guarantee of conformity and defects

If you are a consumer, you have the right to the legal guarantee of conformity for 3 years from delivery, under Decree-Law no. 84/2021 of 18 October. Any lack of conformity that becomes apparent within the first 2 years is presumed to have existed at the date of delivery, unless proven otherwise.

In the event of a lack of conformity you may require the restoration of conformity, by repair or replacement, and, in the cases provided for by law, a reduction of the price or the termination of the contract. Businesses and professionals are subject to the legal period applicable to purchases between professionals.

If the piece arrives broken or defective, write to talkto@relevo3d.com with photographs of the piece and the packaging, preferably within the first days after delivery, so we can claim against the carrier. We reprint or refund the amount.

The guarantee does not cover normal wear, damage from incorrect application, use of interior pieces outdoors, exposure to excessive heat or careless removal from the wall.

9

Intellectual property and submitted content

The site, the images and the texts are ours. The fonts used in the configurator have an open licence, of the SIL Open Font License type, which permits the manufacture and sale of physical objects from their outlines. The licence of each font is indicated on the fonts page.

By uploading a file, you warrant that you own the rights to it or that you have written authorisation from the rights holder, and you grant us a limited licence to use it solely to produce your order. We decline orders with third-party trademarks without authorisation, with no grey area.

We do not produce content that is illegal, that incites hatred, violence or discrimination, that is defamatory, that infringes third-party rights or that is sexually explicit. If we detect such content after payment, we cancel and refund the amount.

You are liable for losses and damages arising from content submitted in breach of this point.

10

Limitation of liability

We are liable for damage caused by breach under the general terms of the law. We are not liable for loss of profit, loss of opportunity or indirect damage, nor for delays caused by the carrier or by circumstances beyond our reasonable control.

Fitting to the wall is your responsibility: follow the instructions provided, check the surface and ensure it can bear the fixing. Nothing in these conditions excludes or limits liability that the law does not allow to be excluded, in particular for wilful misconduct, gross negligence or personal injury.

11

Data protection

The processing of personal data is described in the privacy policy, and the use of cookies in the cookie policy.

12

Applicable law and dispute resolution

Portuguese law applies. If you are a consumer, this does not remove the protection of the mandatory rules of the country where you have your habitual residence.

In the event of a consumer dispute, you may use the European online dispute resolution platform, available at ec.europa.eu/consumers/odr, or an alternative dispute resolution body. The competent body in our case is [ENTIDADE RAL COMPETENTE], at [SITE DA ENTIDADE RAL].

Under Decree-Law no. 156/2005, we have an electronic complaints book, accessible at www.livroreclamacoes.pt.

If the dispute is not a consumer dispute, the courts of the district of [COMARCA COMPETENTE] have jurisdiction, with waiver of any other.

13

Changes

We may change these conditions. The version in force at the time you place the order always applies, and that is the version recorded with the confirmation sent by email.
